Election of Two Supreme Court Candidates Key to Maintaining Objectivity on the Court
Ohio voters will have a number of important decisions to make this year when they head to the polls. In 2006, Ohioans will be asked to vote for a United States senator, Ohio's Governor, Attorney General and Secretary of State, state and congressional representatives, some state senators, state Supreme Court justices, state board of education members, and county officials.
Arguably, one of the most important decisions voters will make is the selection of candidates for the Ohio Supreme Court. Because of the scale and reach of their decisions and their ultimate authority for interpreting the laws of our state, members of the state Supreme Court can have a profound impact on businesses, consumers and taxpayers in Ohio.
The Northern Ohio Political Action Committee (NOMPAC) is educating its members about the importance of the races and the candidates. Ohioans are fortunate to have an experienced, well-qualified set of candidates for the Ohio Supreme Court, many with demonstrated records of judicial leadership.
NOMPAC has endorsed the campaigns of Justice Terrence O'Donnell and Appellate Court Judge Robert C. Cupp because they have illustrated their recognition of the responsibility judges have for interpreting Ohio law not making Ohio law. Following are brief profiles of each of the candidates:
Justice Terrence O'Donnell
Justice Terrence O'Donnell was appointed by Governor Taft to the Supreme Court of Ohio in 2003 to complete the unexpired term of Justice Deborah Cook, who was appointed to the Federal bench. In 2004, he was elected to a full two-year term. Justice O'Donnell has a distinguished judicial background that includes service on both the Common Pleas Court and the Ohio Court of Appeals. He began his legal career as a law clerk to Ohio Supreme Court Justice
J.J.P. Corrigan in 1971. In addition to his judicial service, Justice O'Donnell brings a wide range of related service to the legal profession, particularly with regard to legal education. Justice O'Donnell served as a member of the Supreme Court Professionalism Commission and its Judicial Statistics Committee, as well as on the Court Statistical Reporting Committee, which helps local courts ensure that case statistics are reported and recorded accurately.
Judge Robert R. Cupp
Judge Robert R. Cupp has a legal career that spans over 30 years. He serves on the Ohio Court of Appeals, Third Appellate District, which comprises 17 counties in northwest and west central Ohio. Prior to becoming a judge, Judge Cupp served 16 years as a member of the Ohio Senate. While a state senator, Cupp was a proponent of HB 350, the first comprehensive tort reform legislation that was ultimately overturned by the Ohio Supreme Court in 1999. Before his election to the legislature, he served as a Lima County prosecutor and Assistant Director of Law. He was twice elected Allen County Commissioner and he was engaged in the private practice of law in Lima for over 25 years. In addition to his judicial service, Judge Cupp is a member of the Ohio Commission on Dispute Resolution and Conflict Management appointed by the Chief Justice of the Ohio Supreme Court.
